By submitting a story to Palm, Inc. (“Palm”), you agree to the following:

Palm may use the story you submit about the experiences you have had with Palm handhelds and/or phones (a “Submission”) for business purposes and in marketing and other communications that may include, but not be limited to, promotion of Palm handheld and phone products. Your Submission may be published and distributed, in whole or in part, in any number of forms, including but not limited to print media, electronic media, audio/visual media, and/or via the Internet (social networking sites, world wide web, etc.). You hereby authorize Palm to use the Submission for the purpose(s) described above. You agree and acknowledge that Palm will not be required to seek further approval from you in connection with the publication of the Submission for such purposes.

By entering a Submission, you represent and warrant that your Submission is an original work, that public posting and use of your Submission by Palm will not infringe on or violate the rights of any third party, and that any individuals who are named or identifiable within your Submission have agreed to permit the use of their name, image and/or likeness in connection with your Submission for the purpose(s) described above. You agree to indemnify and hold Palm harmless from any such claims.

This agreement is intended as the complete agreement on this subject matter between Palm and you. This agreement will be governed under the laws of the State of California, excluding its conflict of laws rules. Submission of this form constitutes your agreement with all of its provisions. The Superior Court of the County of Santa Clara or the United States District Court for the Northern District of California shall have jurisdiction and venue over all controversies arising out of, or relating to, this agreement.
